Terms of Service

The ground rules for the Diamond Proxies network: what your money buys, where the limits are, and how far our responsibility extends. If you read one section, make it Acceptable use — do it before your first request goes out.

The agreement

This document (the “Terms”) is the contract between you and Diamond Proxies (“Diamond Proxies”, “we”, “us”). It covers everything we operate: this website, the dashboard, the credentials we issue, the proxy network behind them and anything built around them (collectively, the “Service”).

You are bound by these Terms the moment you do any of three things — open an account, buy bandwidth, or send traffic through the gateway. If any part of this document is unacceptable to you, the answer is simply not to use the Service. Signing up on behalf of an employer or client means you are stating that you have the authority to commit them, and every “you” below refers to that organisation as well as to you.

Personal data is dealt with separately in our Privacy Policy, which is incorporated into and forms part of these Terms.

Who may open an account

Accounts are for adults: you need to be 18 or over and capable of entering a binding contract where you live. You cannot use the Service if the law where you are prohibits it, or if you reside in or are physically located in a territory under comprehensive sanctions.

Registration runs through Discord, which makes your Discord login the front door to everything here — your balance, your order history and your live proxy credentials. Whoever holds that Discord account effectively holds your Diamond Proxies account, so secure it accordingly. Spinning up additional accounts to work around a limit, a price, a promotion or a suspension is not allowed.

Activity carried out under your login or with your credentials is treated as yours, authorised or not. If you suspect either has fallen into someone else's hands, write to support@diamondproxies.com straight away so we can revoke and reissue.

What you are buying

Diamond Proxies sells metered access to residential proxy infrastructure. The model is simple: you top up a bandwidth balance, we hand you credentials, and every request that traverses the gateway is deducted from that balance. There is no subscription and no monthly commitment.

  • Balances do not lapse. Bandwidth you have paid for stays on the account indefinitely — until you spend it, or until the account is closed or terminated under these Terms.
  • The network does the counting. The figures in your dashboard come from upstream usage reporting. They can trail actual consumption and can be corrected after reconciliation; for billing, the network's own accounting is what governs.
  • The pool is fluid. Which IPs, subnets, ASNs and countries are live at any given second is constantly shifting. We make no promise that a specific address, range or geography will be on hand, nor that a particular destination will accept traffic from it.

Features come and go as the product develops. Should we retire something you have already paid for and have no comparable replacement to offer, we will refund the portion you have not yet used.

Pricing and payment

All prices are quoted in U.S. dollars and, unless a page says otherwise, exclude tax. Stripe handles the transaction end to end — completing a purchase means you are also accepting Stripe's terms. Your full card number never reaches us and is never stored on our side.

Billing is per gigabyte at whatever rate checkout displays, after any volume tier or coupon has been applied. A discount honoured once carries no entitlement to it again. Rates can be revised whenever we choose, but a revision only ever affects future purchases — never bandwidth already sitting in your balance.

Sales tax, VAT, GST and equivalent charges arising from your order are yours to settle; taxes on our own income are ours. Where a completed payment is later reversed, disputed or clawed back, we reserve the right to suspend the account and strip out any bandwidth from that payment you have not yet consumed.

Refunds

Bandwidth lands in your account the instant payment clears, and it can be burned through just as quickly. For that reason it is treated as a delivered digital good: sales are final, and refunds are not part of the ordinary course of business.

We will nevertheless look at a refund request in these situations:

  • a duplicate charge, or a charge raised in error;
  • bandwidth that never reached your account and that we are unable to deliver; or
  • a prolonged fault at our end that left the Service unusable and that we failed to fix.

Send the request to support@diamondproxies.com no more than 7 days after the charge. Bandwidth you have already spent is normally outside the scope of any refund. None of this displaces cancellation or refund rights that consumer law in your country grants you regardless.

Acceptable use

A proxy is a neutral piece of plumbing, and the overwhelming majority of what our customers do with it — price intelligence, ad verification, brand protection, market research, QA testing — is perfectly ordinary business. What follows is the short list of things that are off-limits here, without exception.

Cross any of these lines and we will terminate the account on the spot, with no refund, and we will assist law enforcement wherever the law obliges us to. Abuse can be reported to privacy@diamondproxies.com.

Illegal and harmful activity

  • Conduct that breaks the law in your jurisdiction or in ours.
  • Child sexual abuse material, intimate imagery shared without consent, and any content that sexualises a minor.
  • Fraud of any description — phishing, carding, identity theft, laundering, or trafficking in stolen data and credentials.
  • Harassment campaigns, stalking, doxxing, threats, or anything that helps enable violence.
  • Delivering malware, ransomware or spyware, or carrying botnet command-and-control traffic.

Attacks and unauthorised access

  • Denial-of-service and amplification traffic, packet floods, or anything else intended to knock over somebody else's infrastructure.
  • Scanning ports or probing for vulnerabilities, and penetration testing or exploitation of systems you neither own nor hold written authorisation to test.
  • Credential stuffing, brute-forcing logins, hijacking sessions, or otherwise walking around authentication and access controls.
  • Defeating anti-fraud, anti-abuse or identity-verification systems — mass account registration very much included.

Abuse of the network

  • Spam and unsolicited bulk messaging in any channel, whether that is email, SMS or platform DMs.
  • Reselling, sublicensing, pooling or otherwise passing on access to the Service unless we have agreed to it in writing beforehand.
  • Reverse engineering the Service, poking at our infrastructure, or trying to unmask or make contact with the peers whose connections carry residential traffic.
  • Ticketing, sneaker or inventory automation that breaches the target platform's rules, in any place where the law prohibits it.
  • Unlawful collection of personal data, including scraping that contravenes data-protection legislation.

Other people's terms are still your problem. Buying bandwidth from us grants you no licence to ignore another site's terms of service, robots directives or rate limits. That relationship is strictly between you and them, and you cover us for it under Indemnification below.

Fair use and network health

Everyone shares the same network, so we reserve room to protect it: rate limits, concurrency ceilings and destination-specific restrictions are all on the table. We will also block traffic to hosts that have asked us to stop routing to them, or that attract an outsized share of abuse complaints.

Running, metering and defending the Service requires us to look at connection metadata — timestamps, destination hosts, byte counts, error rates. The contents of your traffic are a different matter: we do not examine them, save where a court or law enforcement compels us, or where there is no other way to shut down an attack already in progress.

Credentials and security

The credentials we issue belong to your account alone. Keep them out of public repositories, pastebins and screenshots, and do not hand them to anyone outside your organisation. Where credentials look leaked, shared or abused, we may rotate or revoke them immediately and without warning.

Diamond Proxies itself is not a target: do not use the Service to attack, overload or gain unauthorised access to our own systems, and do not attempt to interfere with bandwidth accounting, quotas or billing.

Suspension and termination

Walking away is always an option — stop using the Service, and ask us to close the account whenever you like. From our side, we may suspend or terminate access, and do so immediately and without notice where the situation calls for it: a breach of these Terms, use that creates legal or security exposure for us, our suppliers or third parties, a failed or reversed payment, or a legal requirement to act.

When a suspension is based on suspected abuse, we will explain the reason unless the law forbids it or doing so would tip off an ongoing investigation, and access goes back on if the concern turns out to be unfounded. Any balance left on an account we terminate for breaching Acceptable use is forfeit and will not be refunded.

Termination does not wipe the slate clean. Intellectual property, Disclaimers, Limitation of liability, Indemnification, Governing law and General all continue to apply afterwards, as do any payments you already owe.

Availability

Keeping the network quick and reachable is the whole job, and we take it seriously — but the Service is furnished strictly on an “as available” footing. We commit to no uptime figure, no latency target, no success rate and no pool size. Numbers you see on our marketing pages describe how the network has performed or typically performs; none of them is a warranty.

Scheduled maintenance, upstream incidents, congestion and blocking by the sites you target will all move those numbers around at times. Events of that kind are not a failure to supply what you paid for.

Intellectual property

Everything that makes up the Service — dashboard, underlying software, documentation, design, the Diamond Proxies name and marks — remains the property of us and our licensors. While your account is in good standing you hold a limited licence to use the Service as intended: non-exclusive, non-transferable and revocable. Rights not expressly granted here stay with us.

Whatever you route through the network remains yours. Feedback and suggestions are the exception: send them and we are free to act on them without restriction, compensation or obligation.

Third-party services

We are not an island. Discord provides sign-in and hosts our support community, Stripe processes payments, and upstream providers carry the network itself. Each of them operates under its own terms and privacy practices, and we cannot answer for what they do or fail to do.

Disclaimers

So far as the law allows, the Service comes “as is” and “as available”, with no warranty attached — express or implied — and specifically none as to merchantability, fitness for a particular purpose, title or non-infringement, nor any warranty implied by how the parties have dealt with each other or by trade custom.

Nothing here is a promise that the Service will run without interruption, without error or without incident, that any given destination will let you through, or that whatever you obtain via the Service will prove accurate or dependable.

Limitation of liability

To the maximum extent the law permits, neither side will be on the hook to the other for indirect, incidental, special, consequential or punitive damages, nor for lost profit, revenue, data, goodwill or business opportunity — and that holds even where the possibility was flagged in advance.

Our liability in total, however it arises out of or relates to the Service, is capped at whichever is greater: USD 100, or what you paid us across the three months preceding the event behind the claim.

Not every jurisdiction permits exclusions and caps of this kind. Where yours does not, the above applies only as far as it lawfully can, and nothing in these Terms purports to exclude liability for fraud or for death or personal injury resulting from negligence.

Indemnification

If a claim, demand, loss, liability, fine or expense — reasonable legal costs included — lands on Diamond Proxies, its officers, employees or suppliers because of how you used the Service, because you broke these Terms (Acceptable use above all), or because you breached a law or somebody else's rights, you will take on the defence and cover us for it.

Changes to these terms

The product moves and so does the law, so these Terms will be revised from time to time. Every revision updates the “last updated” date at the head of this page, and anything material is announced ahead of time — in the dashboard, over email, or in our Discord community — before it takes effect.

Carry on using the Service once a change is live and you are taken to have accepted the revised Terms.

Governing law and disputes

the State of Delaware, United States supplies the governing law here, conflict-of-laws principles excluded. Disputes go to the courts sitting there, exclusively, and you agree to that venue. The one carve-out: either of us can go to any competent court for injunctive relief to protect intellectual property or confidential information.

Consumers keep the benefit of any mandatory protections granted by the law of their home country; nothing above takes those away.

Before anything is filed, please just email support@diamondproxies.com. Almost every dispute we have seen was settled faster that way than any other.

General

Read together with the Privacy Policy, this document is the whole of the agreement between us on this subject and replaces anything discussed or agreed before it. Should a clause turn out to be unenforceable, the remainder stands. Declining to enforce a clause on one occasion waives nothing. These Terms cannot be assigned by you without our agreement, though we may assign them in a merger, acquisition or sale of assets. Nothing in them makes us partners, agents, employer or employee.
